3. ACCEPTANCE OF TERMS
By using Nhusta, you confirm that:

4. If you are a parent or guardian, you have authority to give consent for the learner;
5. If you are a school representative, you are authorised to engage with Nhusta on behalf of the school;
6. You will not use Nhusta for unlawful, harmful, abusive, unauthorised, or inappropriate purposes.
4. USER CATEGORIES
Nhusta may be used by different categories of users, including:
1. Learners;
2. Parents and guardians;
3. Teachers;
4. Schools;
5. School administrators;
6. Partners and funders;
7. Researchers or evaluators;
8. Contractors, suppliers, and service providers;
9. General website visitors.
Different rules may apply to different user categories depending on the product, service, programme, pilot, or agreement involved.
5. USE BY LEARNERS
Learners may use Nhusta’s platform, games, assessments, activities, and learning tools directly, subject to consent requirements and platform rules.
Learners must:

3. Avoid sharing login details with others;
4. Avoid posting or submitting harmful, offensive, false, or inappropriate content;
5. Respect other learners, teachers, schools, and Nhusta staff;
6. Follow instructions provided by Nhusta, parents, guardians, or schools.
Where a learner is under the age of 18, parent or guardian consent may be required for platform use, data collection, assessments, surveys, research, media, or pilot participation.
6. PARENT AND GUARDIAN RESPONSIBILITIES
Parents and guardians are responsible for:
1. Providing accurate consent information;
2. Ensuring that the learner uses Nhusta appropriately;
3. Reading relevant privacy, consent, and participation information;
4. Contacting Nhusta if they have questions about learner participation or data protection;
5. Informing Nhusta if consent must be withdrawn or updated;
6. Ensuring that information submitted on behalf of the learner is accurate.
7. SCHOOL AND TEACHER USE
Where Nhusta is used through a school, pilot, or education programme, the school and teachers may have additional responsibilities under a school agreement, memorandum of understanding, data processing agreement, pilot agreement, or written implementation plan.
Schools and teachers must:
1. Use Nhusta only for approved educational purposes;
2. Support lawful consent processes where required;
3. Protect learner information;
4. Avoid sharing learner data with unauthorised persons;
5. Use reports and learner progress data responsibly;
6. Follow the relevant school agreement or pilot terms.
8. SERVICES PROVIDED BY NHUSTA
Nhusta may provide some or all of the following:
1. Curriculum-linked digital learning platform access;
2. Educational mathematics games;
3. Board game-based mathematics activities;
4. Educational cartoons and related learning content;
5. Assessments and progress tracking;
6. Learner reports;
7. Parent, teacher, and school reports;
8. Pilot programmes;
9. Research, monitoring, evaluation, and learning activities;
10. Training, onboarding, and support;
11. Paid or free educational products, subscriptions, pilots, or services.
Nhusta may change, update, improve, remove, or discontinue features, products, or services from time to time.
9. ACCOUNT REGISTRATION
Some Nhusta services may require registration or user accounts.
Users agree to:
1. Provide accurate registration information;
2. Keep login details secure;
3. Not impersonate another person;
4. Not create accounts using false information;
5. Notify Nhusta of unauthorised account access where known;

10. Use Nhusta content or systems in a way that damages the company, learners, schools, or other users.
11. CHILD SAFETY AND LEARNER PROTECTION
Nhusta is committed to protecting learners and children who use its products and services.
Users must not:
1. Contact learners through Nhusta for unauthorised purposes;
2. Request unnecessary personal information from learners;
3. Share learner images, videos, marks, or personal information without consent;
4. Use Nhusta to exploit, manipulate, embarrass, or harm learners;
5. Use learner data for unrelated commercial purposes.
Nhusta may take action, including suspension, removal, reporting, or legal steps, where learner safety is at risk.
12. EDUCATIONAL PURPOSE AND LIMITATIONS
Nhusta provides educational support tools. Nhusta does not guarantee that every learner will achieve a specific mark, grade, school result, examination result, or academic outcome.
Learner progress depends on many factors, including participation, practice, school support, parental support, learner effort, device access, internet access, and broader learning conditions.
Nhusta’s products are intended to support learning and are not a replacement for teachers, schools, formal curriculum delivery, professional educational assessment, psychological assessment, or official examination processes.
13. ASSESSMENTS AND REPORTS
Nhusta may provide assessments, progress tracking, learning analytics, and reports.
Such reports are intended for educational support, monitoring, evaluation, and improvement purposes. Reports must not be used to shame, punish, discriminate against, or unfairly label learners.
Assessment and game performance data may not always reflect a learner’s complete academic ability. It should be interpreted responsibly and, where necessary, alongside school, teacher, parent, and learner context.
14. FEES, PAYMENTS, AND SUBSCRIPTIONS
Some Nhusta services may be free, while others may require payment, subscription, school purchase, pilot fee, product purchase, or other commercial arrangement.
Where fees apply, the relevant price, payment terms, duration, service description, and refund conditions should be communicated before purchase or participation.
Payments may be processed through third-party payment providers. Nhusta is not responsible for errors, delays, or failures caused by third-party payment systems, except where required by law.
15. REFUNDS
Refunds are governed by Nhusta’s Refund Policy, which should be read together with these Terms and Conditions.
Where a specific signed agreement, invoice, school contract, pilot contract, or service agreement contains refund terms, those terms may apply in addition to or instead of the website Refund Policy, depending on the context.

Nhusta processes personal information in accordance with its Privacy Policy, POPIA Compliance Policy, Child Data Protection Policy, consent forms, and applicable law.
By using Nhusta, users acknowledge that Nhusta may collect and use personal information for legitimate educational, operational, research, reporting, communication, and service-delivery purposes.
20. THIRD-PARTY SERVICES
